1. Acceptance of Terms
These Terms & Conditions apply to all reservations, deliveries, pickups, and use of Equipment provided by TravelTot Vermont (“Provider”). By placing a reservation, making payment, accepting delivery, or using any Equipment, the customer (“Borrower”) agrees to be bound by these Terms & Conditions. Borrower must be at least 18 years old.
2. Definitions
“Equipment” means any item rented, delivered, or made available by Provider under a reservation, together with all related parts and accessories.
“Reservation” means a booking placed through Provider’s website, checkout, email, phone, text, or any other approved ordering method.
“Rental Period” means the period beginning upon delivery or pickup of Equipment and ending when all Equipment is physically retrieved and accepted by Provider.
3. Equipment Condition, Inspection, and Acceptance
Provider inspects and cleans Equipment before delivery to the extent reasonably practicable.
Borrower must inspect all Equipment within two (2) hours of delivery or pickup and notify Provider immediately of any defect, damage, missing part, or other issue. Borrower must not use any Equipment that appears unsafe.
Continued possession or use after the inspection period constitutes acknowledgment that the Equipment was received in acceptable condition, except for defects not reasonably discoverable during inspection.
Borrower may not modify, alter, repair, or remove labels, warnings, or parts from any Equipment.
4. Safe Use and Supervision
Borrower agrees that Equipment will be used only for its intended purpose, in accordance with all manufacturer instructions, warnings, and labels, and within all applicable age, weight, and safety limits.
Children must be supervised at all times while using or near the Equipment.
Borrower is solely responsible for determining whether Equipment is appropriate for use.
5. Assumption of Risk
Use of Equipment involves inherent risks, including the possibility of injury, illness, property damage, and other harm.
To the fullest extent permitted by law, Borrower voluntarily assumes all risks arising from the delivery, setup, possession, transport, installation, use, misuse, or non-use of the Equipment by Borrower or any other person.
6. Release and Limitation of Liability
To the fullest extent permitted by law, Borrower releases Provider and its owners, employees, contractors, and affiliates from claims arising out of use of the Equipment, including claims based on ordinary negligence.
This release does not apply to gross negligence, reckless conduct, willful misconduct, or liability that cannot legally be waived.
Provider is not responsible for loss or theft of personal property.
Provider’s total liability arising out of or relating to a reservation shall not exceed the rental fees actually paid for that reservation.
7. Responsibility for Equipment, Damage, Cleaning, and Loss
Borrower is responsible for Equipment from delivery until it is physically retrieved and accepted by Provider.
Borrower agrees to return Equipment with all parts and accessories, in substantially the same condition as received, ordinary wear and tear excepted, and free of excessive dirt, debris, food residue, stains, odors, smoke odor, pet hair, or other conditions requiring unusual cleaning or repair.
Borrower is responsible for damage beyond ordinary wear and tear, excessive cleaning, missing parts, loss or theft, replacement cost for destroyed or irreparably damaged Equipment, and late returns.
If Equipment is left at a hotel, vacation rental, porch, airport, or any other location and is lost, missing, inaccessible, or stolen, Borrower remains responsible until Provider physically retrieves and accepts the Equipment.
8. Payment Authorization and Security Deposit
Borrower authorizes Provider to charge the payment method on file for rental fees, delivery fees, schedule-change fees, late fees, cleaning fees, repair charges, replacement cost, retrieval or re-delivery fees, and any other amounts due under these Terms & Conditions.
Provider will require a refundable security deposit equal to fifty percent (50%) of the total rental amount for all reservations. This deposit will be collected at the time of reservation.
The security deposit will be refunded within one (1) day after return and inspection of all Equipment, less any applicable charges for damage, loss, cleaning, or late return.
9. Delivery and Pickup Policy
Free delivery is available to most of Chittenden County. A $30 delivery fee applies to Bolton, Jericho, Underhill, Charlotte, Cambridge, Huntington, St. George, Richmond, Fairfax, and Westford.
Depending on destination, Provider generally requires a two- to four-hour delivery and pickup window. Airport orders may be handled differently and can be coordinated around arrival and departure times.
Once a delivery or pickup window is confirmed, Borrower is responsible for ensuring that someone is present during that window or that Provider has safe and lawful access to the location.
If no one is available or Provider cannot access the location during the confirmed delivery or pickup window, Provider will attempt to reschedule. A second-trip or rescheduling fee of $10 applies to Colchester, Winooski, Milton, Essex, South Burlington, Burlington, Shelburne, and Williston. A second-trip or rescheduling fee of $35 applies to Bolton, Jericho, Underhill, Charlotte, Cambridge, Huntington, St. George, Richmond, Fairfax, and Westford.
If the destination is a vacation rental or managed property, Borrower is responsible for notifying the property management company in advance that Provider will deliver and pick up Equipment. Delays or losses caused by failure to coordinate access may result in additional fees.
If the property is located in a gated community, Borrower is responsible for providing gate codes or notifying gate personnel in advance. Delays caused by missing or incorrect access instructions may result in additional charges.
10. Porch Delivery and Porch Pickup Policy
If Borrower selects porch delivery or porch pickup, Borrower is responsible for ensuring the designated location is secure and accessible.
Borrower remains responsible for lost or stolen Equipment from a porch or outdoor location until Provider physically retrieves and accepts the Equipment. Borrower should place Equipment in a hidden or otherwise protected area whenever possible.
11. Hotel Delivery and Hotel Return Policy
For hotel orders, delivery and pickup are typically handled through the hotel bell closet or another designated hotel location.
Borrower is responsible for making sure Equipment is tagged and placed in the designated return location at the beginning of the selected pickup window. Borrower should not leave Equipment in a hotel room after checkout.
If Equipment is not left in the designated return location and Provider spends excessive time locating it, an additional $45 retrieval fee may apply.
If a hotel charges Provider a retrieval fee because Equipment was left with unauthorized staff or in an incorrect location, that hotel retrieval charge may be passed through to Borrower.
Borrower remains responsible for lost hotel-return items even after checkout. Borrower should tag Equipment with Borrower’s name and may wish to note the name of the hotel staff member who accepted the return.
12. Schedule Changes
Requests to change delivery or pickup dates, times, or locations are subject to Provider’s availability.
Requests made within twenty-four (24) hours of the scheduled delivery or pickup may result in a schedule-change fee or may not be accommodated.
13. Cancellations and Refunds
Reservations canceled more than seventy-two (72) hours before the scheduled delivery date are generally refundable, subject to any disclosed non-refundable processing fees.
Reservations canceled within seventy-two (72) hours of delivery may be charged fifty percent (50%) of the product total or the applicable minimum order amount for the service area, whichever is greater.
No refunds are provided after delivery, including for early return, unused rental time, changed travel plans, or early termination of the Rental Period.
If reserved Equipment becomes unavailable or unsafe, Provider may substitute comparable Equipment or issue an appropriate refund for the affected item.
14. Governing Law and Disputes
These Terms & Conditions are governed by the laws of the State of Vermont.
The parties agree to attempt to resolve disputes informally before filing a claim.
Any legal action arising out of or relating to these Terms & Conditions shall be brought in Vermont state courts, and the parties consent to jurisdiction and venue in Vermont. Small claims court may be used where applicable.
15. Miscellaneous
If any provision of these Terms & Conditions is found unenforceable, the remaining provisions will remain in full effect.
These Terms & Conditions constitute the entire agreement between Borrower and Provider regarding the reservation and rental of Equipment.
By checking the Terms & Conditions box and completing checkout, or by placing a reservation through any approved reservation method, Borrower confirms that Borrower has read and understood these Terms & Conditions and agrees to be bound by them. Electronic acceptance is legally binding and no handwritten signature is required.
